At VINTQ (as referenced throughout this Privacy Policy as “VINTQ,” “we,” “us,” and “our”), we treat your privacy as a priority. Although this Privacy Policy is focused on how we collect, use, and share your personal data, we operate under the following foundational principles. 1. What this Privacy Policy Covers
This Privacy Policy explains how we process Personal Data that we collect when you access or use our Services. “Personal Data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked (directly or indirectly) with a particular individual, and includes information described as “personally identifiable information” or “personal information” under applicable data protection laws, rules, or regulations, including those applicable in EU Member States and the General Data Protection Regulation (GDPR) where relevant. This Privacy Policy does not address the practices of companies we do not own or control, nor of persons we do not manage.

Directly from You
We collect Personal Data about you when you provide information directly to us by doing any of the following:

• Voluntarily providing information in free-form text boxes through the Services or through responses to surveys or questionnaires.

• Applying for a job with us.
Your Use of the VINTQ Website
When you use the Services, Personal Data may be collected automatically in the following ways:
• Through Cookies (defined in the “Tracking Tools, Advertising and Opt-Out” section below).
• If you download our mobile application or use a location-enabled browser, we may receive information regarding your location and mobile device, as applicable.
• If you download and install certain applications and software we make available, we may receive and collect information transmitted from your computing device for the purpose of providing the relevant Services, including information about when you are logged in and available to receive updates or alert notices.
Other Users
We may contact you if another User (as defined in our Terms of Service) invites you to follow their VINTQ gallery through the Services. If you invite a third party to follow your VINTQ gallery through our Services, we will use that party’s email address solely for the purpose of sending your invitation. You must obtain permission from other individuals before providing their contact information to us. If you do not have permission to share an individual’s information with us, you must not submit any such information to VINTQ.
Third parties
We may also obtain Personal Data from the following third parties:
• Vendors. We may use analytics service providers to assess how you interact with and engage with the Services, and third parties may also assist us in providing customer support. We may use vendors to obtain information to generate leads and to develop user profiles.
• Advertising and marketing partners. We receive information about you from certain vendors who assist us with marketing or promotional services. This may include information relating to how you interact with our websites, applications, products, Services, advertisements, or communications. In addition, we may receive contact information and certain commercial information from data cooperatives and other third-party data aggregators.
Social Networks
If you provide your social network account credentials to us, or otherwise sign in to the Services using a third-party site or service, certain content and/or information from those accounts may be transmitted into your account with us—for example, your name and email address—and additional information may be provided as needed to authenticate your access to the Services in the future.
5. Our Commercial or Business Purposes for Collecting Personal Data
We collect and process your Personal Data for commercial and business purposes in order to do the following:
Providing, Customizing, and Improving the Services
• Creating and managing your account or other user profiles.
• Processing orders and other transactions; billing.
• Providing you with the products, services, or information you request.
• Meeting or fulfilling the purpose for which you provided the information to us.
• Providing support and assistance in connection with the Services.

• Marketing and selling the Services, including sending catalogues and promotional materials by email or direct mail, where permitted by law.
• Presenting advertisements to you, including interest-based or online behavioural advertising, subject to applicable consent requirements where required in EU Member States.
Corresponding with You
• Responding to communications we receive from you, contacting you where necessary or requested, and sending you information about VINTQ or the Services.
• Sending emails and other communications based on your preferences or containing content we believe may be of interest to you.
• If you elect to receive promotional offers on your mobile device, we may send SMS, MMS, or other text messages (“Text Message”) regarding such promotional offers to the number you provided. We may collect information about such communications (including confirmation that a Text Message was opened or read, where available) and use such information to operate and improve our Services, including customer service functions, or as otherwise permitted under this Privacy Policy. Text Messages, reply “STOP” to any such message.
Meeting Legal Requirements and Enforcing Legal Terms
• Complying with applicable law, regulation, court order, or legal process, including preventing, detecting, and investigating security incidents and potentially unlawful or prohibited activity.
• Protecting the rights, property, or safety of you, VINTQ, or another party.
• Enforcing agreements between you and us.
• Responding to allegations that content posted through the Services infringes third-party rights.
• Resolving disputes and addressing complaints.
We will not collect additional categories of Personal Data, nor use previously collected Personal Data for materially different, unrelated, or incompatible purposes, without providing you notice and, where required by applicable law, obtaining your consent.
6. How We Share Your Personal Data
We disclose your Personal Data to the categories of service providers and other parties described in this section. Depending on the laws applicable to you, including certain EU state privacy laws, some of these disclosures may constitute a “sale” of your Personal Data as defined under those laws. For additional detail, please refer to any state-specific or region-specific provisions below. In EU Member States, disclosures for advertising and analytics may also be treated as separate processing activities requiring an appropriate legal basis and, where applicable, consent.
With Service Providers. These entities help us provide the Services and/or perform business functions on our behalf, including:
• Hosting, technology, and communications providers.
• Security and fraud prevention consultants.
• Analytics providers.
• Support and customer service vendors.
• Product fulfilment and delivery providers.
• Payment processors.
With Advertising Partners and Select Partners. These parties support marketing and may present offers that may be relevant to you, including:

• Marketing providers.
For example, we may disclose information to advertising partners and companies providing advertising-related services, as well as data brokers and marketing cooperatives (our “Select Partners”), to deliver advertising more relevant to your interests. Such information may include identifiers (such as IP address, advertising identifiers, or email address), demographic indicators (such as age and gender where provided), internet or other electronic network information (including your interaction with an advertisement), geolocation data, and commercial data (including purchase history). We may combine information you provide online or through catalogues with publicly available information and information received from, or cross-referenced against, our Select Partners in order to personalize the Services and to communicate offers that may be of interest to you. In addition, we may rent, exchange, share, and/or cross-reference information (including contact information) with data broker and marketing cooperative partners in a manner enabling those partners to send you promotional materials and catalogues relating to products and services that may interest you, subject to applicable law and opt-out/consent requirements.
With Business Partners. These parties partner with us in offering certain services, including:
• Businesses with which you already maintain a relationship.
• Companies with whom we collaborate to provide joint promotional offers or opportunities.
With Parties You Authorize, Access, or Authenticate
• Third parties you access through the Services.
• Social media services. For example, if you sign in using third-party social media credentials and choose to “Follow” a User of VINTQ, you consent to VINTQ posting a notification to your social media account (such as a notice on a Facebook wall) stating that you are “following” that User. You may opt out of these social media posts at any time by emailing us at info@vintq.com or by adjusting your preferences within your account settings.
To Fulfil Legal Obligations
We may share Personal Data with third parties in connection with the activities described under “Meeting Legal Requirements and Enforcing Legal Terms” in the “Our Commercial or Business Purposes for Collecting Personal Data” section above.
In Connection with Business Transfers
All Personal Data we collect may be transferred to a third party if we undergo a merger, acquisition, bankruptcy, or other transaction in which a third party assumes control of our business (in whole or in part). If such an event occurs, we will use reasonable efforts to notify you before your information becomes subject to materially different privacy and security policies and practices.
Data that is Not Personal Data
We may generate aggregated, de-identified, or anonymized data from Personal Data, including by removing information that makes the data identifiable to a particular individual. We may use and share such aggregated, de-identified, or anonymized data for lawful business purposes, including to analyze, develop, and improve the Services and to promote our business, provided that we do not share such data in a manner that would reasonably identify you.
7. International Data Transfers
We may transmit information between and among our affiliates and service providers. As a result, your information may be processed in jurisdictions outside your country of residence, where privacy protections may differ from those in your jurisdiction, including jurisdictions within and outside the European Economic Area (“EEA”). Nonetheless, where feasible, we take measures intended to ensure personal information is treated in accordance with the privacy principles applicable under the laws of the jurisdiction in which we first received your information. By submitting your personal information to us, you agree that your information may be transferred, stored, and processed in a country other than your country of residence, including, but not necessarily limited to, the United States. 8. Tracking Tools, Advertising and Opt-Out
The Services use cookies and similar technologies such as pixel tags, web beacons, clear GIFs, and JavaScript (collectively, “Cookies”) to enable our servers to recognize your browser and to determine how and when you visit and use our Services, to analyze trends, to understand our user base, and to operate, maintain, and improve our Services. Cookies are small pieces of data—typically text files—stored on your computer, tablet, phone, or similar device when you use that device to visit our Services. We may also supplement the information we collect from you with information received from third parties, including third parties that place their own Cookies on your device(s). Please note that, due to our current Cookie usage, the Services do not respond to “Do Not Track” signals transmitted by browsers at this time.
We use the following types of Cookies:
• Essential Cookies. Essential Cookies are necessary to provide features or services you request. For example, certain Cookies allow you to access secure areas of the Services. Disabling these Cookies may prevent certain features and services from functioning.

• Performance/Analytical Cookies. Performance/Analytical Cookies help us understand how visitors use the Services, including the number of visitors, pages viewed, and time spent on pages. • Retargeting/Advertising Cookies. Retargeting/Advertising Cookies collect information about your online activity and infer your interests so that we may deliver advertising we believe is relevant to you. For additional detail, see the section titled “Information about Interest-Based Advertisements.”
When you first visit the VINTQ website, you will be presented with options to select which Cookies you accept. Except for Essential Cookies, you may choose whether to accept other categories of Cookies. You can manage your Cookie preferences at any time by selecting Manage Cookies in the footer of the VINTQ website.
You may also manage Cookies through your browser settings. Many browsers permit you to disable Cookies, prevent acceptance of new Cookies, or prompt you regarding acceptance of each Cookie. You may also delete Cookies that are already stored on your device. If you do so, you may need to manually reset preferences each time you visit, and some Services or functionality may not operate properly. 9. Information about Interest-Based Advertisements
We may display advertisements and also permit third-party ad networks—including third-party ad servers, ad agencies, ad technology vendors, and research firms—to deliver advertisements through the Services. These advertisements may be targeted to Users who fall within certain profile categories or who demonstrate certain preferences or behaviours (“Interest-Based Ads”). Information used for Interest-Based Ads (including Personal Data) may be provided directly by you or derived from user activity patterns on the Services and/or on third-party services. Such information may be collected by tracking Users’ activity over time and across unaffiliated properties, including after a User leaves the Services. To enable this, we or our service providers may deliver Cookies to your device, including files known as “web beacons,” through the Services. Web beacons allow ad networks to provide anonymized, aggregated auditing, research, and reporting to us and advertisers, and also enable targeted advertising when you visit other websites. Web beacons may allow ad networks to view, edit, or place their own Cookies on your browser, as if you requested content directly from their sites.
10. Data Security and Retention
We implement appropriate physical, technical, organizational, and administrative safeguards designed to protect your Personal Data against unauthorized access, use, alteration, and disclosure, taking into account the nature of the data and the manner in which it is processed. For example, the Services use industry-standard Secure Sockets Layer (SSL) encryption to protect certain Personal Data transmitted to us. You are responsible for helping to safeguard your information by choosing and protecting your password and other sign-on credentials, limiting access to your device and browser, and logging out after completing use of your account.
While we take steps intended to protect the security of your account and the data we maintain, no method of transmission over the internet or method of electronic storage is fully secure. Accordingly, we cannot guarantee absolute security of any information you transmit to us, and—except where expressly required by law—we are not responsible for theft, destruction, loss, or inadvertent disclosure of your information or content.
We retain Personal Data for as long as you maintain an open account with us and/or as needed to provide the Services. In certain circumstances, we may retain Personal Data for longer periods where necessary to comply with legal obligations, resolve disputes, collect amounts owed, or as otherwise permitted or required by applicable law, rule, or regulation. We may also retain certain information in anonymized or aggregated form where it cannot reasonably be used to identify you.
11. Personal Data of Children
As stated in the Terms of Service, we do not knowingly collect or solicit Personal Data from children under 16 years of age. If you are under 16, please do not register for, use, or otherwise access the Services, and do not send us any Personal Data. If we become aware that we have collected Personal Data from a child under 16 years of age, we will delete such information as promptly as reasonably possible. 12. EU Resident Rights
If you are a resident of an EU Member State (or otherwise located in the European Economic Area), you may have rights under the GDPR with respect to your Personal Data, including, as applicable: the right of access, the right to rectification, the right to erasure, the right to restriction of processing, the right to data portability, the right to object, and the right to withdraw consent where processing is based on consent. You may also have the right to lodge a complaint with a competent supervisory authority in your EU Member State of residence, place of work, or place of the alleged infringement.
If you are a California resident, you may have the rights set forth in this section. Please note that we may process Personal Data of our customers’ end users or employees in connection with our provision of certain services to our customers. If we are processing your Personal Data as a service provider, you should contact the entity that collected your Personal Data in the first instance to address your rights with respect to such data.
If there are any conflicts between this section and any other provision of this Privacy Policy and you are a California resident, the provision that is more protective of Personal Data shall control to the extent of the conflict. Right to Access
You have the right to request certain information regarding our collection and use of your Personal Data over the past 12 months. In response, we will provide:

• The business or commercial purpose for collecting or selling your Personal Data.
• The categories of third parties with whom we have shared your Personal Data.
• The specific pieces of Personal Data collected about you.
If we have disclosed your Personal Data for a business purpose over the past 12 months, we will identify the categories of Personal Data shared with each category of third-party recipient. If we have sold your Personal Data over the past 12 months, we will identify the categories of Personal Data sold to each category of third-party recipient.
Right to be Deleted
You have the right to request deletion of the Personal Data we have collected from you. Under the GDPR, this right is subject to exceptions—for example, we may need to retain Personal Data to provide the Services or complete a transaction or action you requested. If an exception applies, we may deny the deletion request.
Right to Opt-Out of Personal Data “Sales”
You have the right to opt out of the “sale” of your Personal Data. In this section, “sell” and “sale” have the meanings assigned in the GDPR. We sell Personal Data, subject to your right to opt out.
As described in the “Tracking Tools, Advertising and Opt-Out” section above, we use third-party Cookies within our Services. These Cookies enable third parties to receive information about your activity that is associated with your browser or device. Those third parties may use the information to serve advertisements on our Services and/or on other websites. Under the GDPR, sharing information via third-party Cookies for online advertising may be considered a “sale.” You can opt out by following the methods below.

After you submit an opt-out request, we will not request that you reauthorize the sale of your Personal Data for at least 12 months. To our knowledge, we do not sell Personal Data of minors under 16 years of age.
Right Not to Be Discriminated Against
We do not discriminate against individuals for exercising rights under the GDPR. We will not deny goods or services, charge different prices or rates, or provide a different level or quality of goods or services because you exercised your rights. However, we may offer different tiers of Services, where permitted, with pricing or quality differences reasonably related to the value of Personal Data we receive.
Exercising Your Rights
To exercise the rights described above, you or your Authorized Agent (as applicable) must submit a request that: (1) provides sufficient information to enable us to verify you as the person about whom we collected Personal Data, and (2) describes your request with sufficient detail to allow us to understand, evaluate, and respond. Each request meeting these criteria is a “Request.” We may not respond to requests that do not meet these requirements. We will use Personal Data provided in a Request solely to verify identity and complete the request. An account is not required to submit a Request.
We aim to respond within 45 days of receiving your Request. We do not charge a fee unless a Valid Request is excessive, repetitive, or manifestly unfounded. If a fee applies, we will notify you and explain the basis before completing the request.

Notice of Financial Incentive.
We may offer promotional offers or sweepstakes (collectively, the “Programs”). When you enroll in a Program, we typically request your name and contact information (such as email address and/or phone number). Because these Programs involve collecting personal information, they may be viewed as a “financial incentive” program under California law. The value of your personal information to us is reasonably related to the value of discounts, benefits, or other offers you receive through the Program, less the expenses associated with providing those benefits. You may withdraw from a Program at any time by using the method specified in the applicable Program rules.

You may request deletion of your personal data:
• On the website, by selecting the “Do Not Sell My Info” link in the website footer;
• In the app, by accessing “Data Preferences” within the “Account” section of the VINTQ mobile application;
• By following the deletion request process described above; and/or

15. Changes to this Privacy Policy
We continually work to improve our Services, and we may update this Privacy Policy from time to time. If we do so, we will provide notice of changes by posting a notice on www.vintq.com, sending an email, and/or by other appropriate means. Please note that if you have opted out of receiving legal notice emails from us (or have not provided an email address), legal notices will still govern your use of the Services, and you remain responsible for reviewing them. Your continued use of the Services after changes are posted constitutes acceptance of the updated Privacy Policy. Our use of information we collect is subject to the Privacy Policy in effect at the time such information is collected.
